THESE TERMS REQUIRE THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS. THESE TERMS ALSO CONTAIN A WAIVER AND RELEASE REGARDING YOUR NAME, IMAGE, AND LIKENESS CAPTURED WHILE WE PROVIDE SERVICES TO YOU. BY PLACING AN ORDER FOR SERVICES, YOU CONFIRM THAT YOU ARE OF LEGAL AGE AND THAT YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU ARE ACTING ON BEHALF OF A COMPANY OR ORGANIZATION, YOU CONFIRM THAT YOU HAVE THE LEGAL AUTHORITY TO BIND THAT ENTITY. YOU MAY NOT PURCHASE OR USE SERVICES IF YOU DO NOT AGREE TO THESE TERMS, IF YOU ARE NOT AT LEAST 18 YEARS OLD, OR IF APPLICABLE LAW PROHIBITS YOUR ACCESS OR USE.

These Purchase Terms and Conditions apply to all services offered through the Luxe Automation website located at www.luxeautomation.io. Luxe Automation (referred to as “we” or “us”) may update these Terms at any time with reasonable notice, which may be provided electronically or by updating the Last Updated Date on the Site. Your continued use or purchase after updates means you accept the changes.

These Terms work together with the Site Terms and Conditions and the Privacy Policy located on the Site. In the event of a conflict, the order of priority is as follows: (1) these Terms, (2) the Privacy Policy, (3) the Site Terms and Conditions.

1. Order Acceptance and Cancellation; Services; Term and Termination

Your order is an offer to purchase services under these Terms. We may accept or reject any order at our discretion. If we reject an order, we will provide notice and issue a proportional refund.

Luxe Automation provides automation consulting, AI workflow development, system design, and related digital services. You agree that all materials and insights we provide are confidential and exclusively for your own use. You will not share access, accounts, or materials with others without written consent.

These Terms begin when you purchase services and continue until completion unless ended earlier. Either party may terminate this agreement with written notice. Certain sections survive termination by their nature.

2. Prices and Payment Terms

Prices, promotions, and discounts may change without notice. The price at checkout is the final price for your order. Taxes and additional charges may apply.

Payments must be made before service delivery. We accept major credit cards. By purchasing, you confirm that your payment information is valid and that you are authorized to use it.

Refund requests through the payment provider will not be approved unless they meet the specific conditions listed in these Terms.

3. Returns and Refunds

Refunds are only available if:

Luxe Automation cancels or rejects your order, or
You request a refund within thirty calendar days of purchase by contacting denismuthoga@gmail.com.

Refunds are processed within five business days after approval and returned to the original payment method. Refunds apply only to initial purchases, not subscriptions or renewals.

4. Warranty and Disclaimers

All services are provided “as is” without any warranty of merchantability, fitness for a particular purpose, or non infringement. Some jurisdictions do not allow limitations on implied warranties so these limitations may not apply.

Luxe Automation provides business automation services for informational and operational purposes. We do not guarantee specific business outcomes, financial results, or performance metrics. You are solely responsible for your business decisions.

5. Limitation of Liability

Luxe Automation is not liable for any indirect, incidental, special, punitive, or consequential damages including loss of revenue or profits. Our maximum liability is limited to the amount you paid for services in the twelve months before the event giving rise to the claim.

6. Publicity Waiver and Release

By using our services, you grant Luxe Automation the right to use your name, image, and likeness for marketing, advertising, and promotional purposes without additional payment. You waive all claims related to this usage and agree not to bring legal action based on these promotional rights.

7. Not for Resale or Export

You agree that services purchased are for your own use and will not be resold or transferred.

8. Privacy and Confidential Information

Our Privacy Policy governs personal data. You understand we may use third party tools that have their own privacy terms.

Confidential Information includes any non public material shared during service delivery. You agree to keep such information confidential and only use it to work with Luxe Automation. Exceptions apply to information that becomes public or is required to be disclosed by law.

9. Force Majeure

Luxe Automation is not liable for delays or failures caused by circumstances outside our control such as natural disasters, war, government actions, labor disputes, pandemics, or system outages.

10. Governing Law

These Terms are governed by the laws of the State of New York.

11. Dispute Resolution and Arbitration

All disputes related to your purchase or use of services must be resolved through binding arbitration. You waive the right to participate in class actions or representative claims. Arbitration will be handled by the American Arbitration Association in accordance with its Consumer Arbitration Rules.

You may choose small claims court instead of arbitration if you notify us in writing within sixty days of purchase. Arbitration will be conducted on an individual basis only.

12. Assignment

You may not assign your rights or obligations under these Terms without written approval. Luxe Automation may use contractors and third party service providers at its discretion.

13. No Waivers

Failure to enforce any part of these Terms does not waive any rights.

14. No Third Party Beneficiaries

These Terms do not create rights for any third parties. Luxe Automation owns all intellectual property related to its services.

15. Notices

You agree that Luxe Automation may contact you by email or by posting notices on the Site. You are responsible for keeping your contact information updated.

16. Severability

18. Entire Agreement

These Terms, along with the Privacy Policy and Site Terms, form the entire agreement between you and Luxe Automation regarding service purchases.
